Terms of service
Terms of Service
Overview
Welcome to Mad Tea Party. In these Terms, “we,” “us,” “our,” and “Mad Tea Party” refer to Mad Tea Party.
We run this store and website, including their content, features, tools, products, and services (together, the “Services”), to provide you with a shopping experience. Our Services are powered by Shopify.
These Terms of Service, together with the policies they refer to, explain your rights and responsibilities when you use our Services. Please read them carefully. They include important information about warranties and limits on our liability.
By visiting, using, or interacting with our Services, you agree to these Terms and our Privacy Policy [LINK]. If you do not agree, please do not use the Services.
1. Access and accounts
By using our Services, you confirm that you are old enough to enter into a legal agreement in your state or province of residence. You also confirm that you allow any minor dependants to use the Services on devices that you own, buy, or manage.
We may ask you for information such as your email address, billing details, payment details, and delivery address. You must make sure that all information you provide is accurate, current, complete, and that you have the right to provide it.
You are responsible for keeping your account details secure and for all activity carried out through your account. You may not sell, transfer, assign, or licence your account to anyone else.
2. Our products
We try to show our products and services accurately. However, colours and appearances may look different depending on your device, screen settings, and configuration.
We cannot guarantee that a product or service will look exactly as shown online or meet every expectation you may have.
We may change product descriptions at any time without notice. We may also stop selling a product at any time or limit the quantities available to certain people, regions, or jurisdictions.
3. Orders
When you place an order, you are making an offer to buy from us. We may accept or decline an order for any reason. An order is only accepted when Mad Tea Party confirms that it has been accepted, and we must receive and process payment before this happens.
Please check your order carefully before submitting it. Once an order has been accepted, we may not be able to cancel it. If we decline, change, or cancel an order, we will try to contact you using the email address, billing address, and/or phone number you gave us when placing the order.
You confirm that anything you buy is for personal or household use only, and not for commercial resale or export.
4. Prices and billing
Prices, discounts, and promotions may change without notice. The price you pay will be the price shown when you place your order and will be confirmed in your order confirmation email.
Unless we clearly say otherwise, listed prices do not include taxes, delivery, handling, customs, or import charges.
Prices on our website may differ from prices in physical shops or shops run by third parties. From time to time, we may run promotions with separate terms. If those promotion terms conflict with these Terms, the promotion terms will apply.
You must provide accurate, complete, and up-to-date purchase, payment, and account information. You must promptly update your email address, card details, expiry dates, and other relevant information so we can process your transactions and contact you when needed.
By placing an order, you confirm that:
-
The card details you provide are accurate and complete.
-
You are authorised to use that card.
-
Your card provider will honour the charges.
-
You will pay all charges at the listed prices, including delivery, handling, and applicable taxes.
5. Shipping and delivery
Delivery dates are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control.
Once we hand your order to the delivery carrier, ownership and the risk of loss or damage pass to you.
6. Intellectual property
The Services and their contents—including trademarks, brand names, text, images, graphics, reviews, video, audio, and the design and arrangement of these materials—belong to Mad Tea Party, its affiliates, or its licensors. They are protected by intellectual-property laws in the United States and other countries.
You may use the Services only for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, perform, republish, download, store, or transmit any part of the Services without our written permission.
Nothing in these Terms gives you ownership of, or a licence to use, any patent, trademark, copyright, or other intellectual property belonging to Mad Tea Party, Shopify, or another third party, unless we expressly say so in writing. Unauthorised use may breach intellectual-property laws. All rights not expressly granted are reserved by Mad Tea Party.
Mad Tea Party’s names, logos, product names, service names, designs, and slogans are trademarks of Mad Tea Party, its affiliates, or licensors. You must not use them without our written permission.
Shopify’s name, logo, product names, service names, designs, and slogans are Shopify trademarks. All other names, logos, product names, service names, designs, and slogans belong to their respective owners.
7. Optional third-party tools
We may provide access to tools supplied by third parties. We do not monitor, control, or influence these tools.
These tools are provided “as is” and “as available,” without warranties, representations, conditions, or endorsement from us. We are not liable for anything arising from your use of optional third-party tools.
You use these tools at your own risk. Before using them, you should review and accept the relevant third party’s terms.
Any new features, tools, or resources we introduce as part of the Services will also be covered by these Terms.
8. Third-party links
The Services may include links, materials, or features provided by third parties. We are not responsible for checking the content, accuracy, or reliability of third-party websites or materials.
If you leave our Services to access a third-party website, you do so at your own risk. We are not liable for any loss or damage connected with your use of third-party websites or anything you buy, use, or access through them.
Please review a third party’s policies before entering into a transaction with them. Any complaints, questions, or claims about third-party products or services should be directed to that third party.
9. Our relationship with Shopify
Mad Tea Party uses Shopify to provide the Services. However, all sales and purchases made through our store are directly between you and Mad Tea Party.
Shopify is not responsible for any part of a sale between you and Mad Tea Party, including any injury, loss, or damage caused by products or services you purchase from us. By using the Services, you release Shopify and its affiliates from claims, damages, and liabilities connected with your purchases or transactions with Mad Tea Party.
10. Privacy
The personal information we collect through the Services is handled under our Privacy Policy. Some information may also be covered by Shopify’s Privacy Policy. By using our Services, you confirm that you have read these policies.
Because Shopify hosts the Services, Shopify collects and processes information about how you access and use them in order to operate and improve the Services. Information you submit may be shared with Shopify and with third parties, including parties located outside your country of residence, where necessary to provide services to you.
For more details about how we, Shopify, and our partners use personal information, please read our Privacy Policy [LINK].
11. Feedback, reviews, and suggestions
If you send us ideas, suggestions, reviews, feedback, proposals, plans, or other content (“Feedback”), you give us a permanent, worldwide, transferable, sublicensable, royalty-free right to use, copy, change, publish, distribute, and display that Feedback in any format and for any purpose, including commercial purposes.
For example, we may use Feedback to run, assess, improve, promote, and provide the Services.
You confirm that:
-
You own the Feedback or have all rights needed to submit it.
-
You have disclosed any payment, incentive, or compensation you received for submitting it.
-
Your Feedback complies with these Terms.
We do not have to keep Feedback confidential, pay you for it, or respond to it.
We may monitor, edit, or remove Feedback, but we are not required to do so. We may remove Feedback that we believe is unlawful, offensive, threatening, defamatory, pornographic, obscene, otherwise objectionable, or in breach of these Terms or someone else’s intellectual-property rights.
Your Feedback must not infringe anyone else’s rights, including copyright, trademark, privacy, personality, or other personal or proprietary rights. It must not contain unlawful, abusive, defamatory, or obscene material, viruses, or other harmful code.
You must not use a false email address, pretend to be someone else, or mislead us or others about where Feedback came from. You are responsible for the Feedback you submit and for its accuracy. We are not responsible for Feedback posted by you or by anyone else.
12. Errors and inaccuracies
Sometimes the Services may contain errors, omissions, or inaccurate information relating to product descriptions, prices, promotions, offers, delivery charges, delivery times, or availability.
We may correct errors, update information, or cancel orders at any time without notice, including after you have placed an order.
13. Prohibited uses
You may use the Services only for lawful purposes. You must not use them, directly or indirectly:
-
For unlawful or malicious purposes.
-
To break any international, national, provincial, state, or local law or regulation.
-
To infringe our intellectual-property rights or anyone else’s.
-
To harass, abuse, insult, harm, defame, threaten, intimidate, or otherwise harm our employees or any other person.

-
To send advertising or promotional material such as spam, junk mail, chain letters, or similar messages.
-
To impersonate another person or organisation.

You must also not:
-
Upload or send viruses or other harmful code.
-
Copy, extract, sell, resell, or exploit any part of the Services.
-
Collect or track other people’s personal information.
-
Spam, phish, pharm, or pretext through the Services.
-
Use robots, spiders, scrapers, data-extraction tools, automated processes, agentic AI, or manual methods to access the Services.
-
Interfere with or bypass security features, access controls, robot exclusion headers, or other measures we use to control access.
We may suspend, disable, or terminate your account without notice if we believe you have broken these Terms.
14. AI and automated agents
This section applies if you use, allow, enable, or cause an automated agent to access, use, or interact with the Services.
An “Agent” means software or a service that takes autonomous or semi-autonomous actions for a person or organisation, or on their instructions, and can operate on a person’s device without direct supervision.
An Agent may only access, use, or interact with the Services if it identifies itself at all times and follows the rules below. An Agent must also stop accessing, using, or interacting with the Services if we ask it to do so.
We may use technical measures to limit whether and how Agents access, use, or interact with the Services.
Every Agent must:
-
Identify itself in every HTTP/HTTPS request by including
Agent/[agent name]in its user-agent string. -
Never hide or disguise the fact that it is an Agent, including by imitating human behaviour or interaction patterns.
-
Never complete or bypass CAPTCHAs or other systems designed to tell humans and computers apart.
-
Answer truthfully if asked whether it is a human or a computer.
-
Never bypass measures designed to block, limit, change, or control Agent access to the Services.
15. Termination
We may end these Terms or your access to all or part of the Services at any time and without notice. You will still be responsible for all amounts you owe up to and including the date of termination.
The following sections will continue after termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other terms that should reasonably continue after termination.
16. Disclaimer of warranties
Information on the Services is provided for general information only. We do not guarantee that it is accurate, complete, or useful. You rely on it at your own risk, and we are not responsible for any loss caused by reliance on it.
Except where Mad Tea Party expressly states otherwise, the Services and all products offered through them are provided “as is” and “as available.” We make no express or implied warranties or conditions, including warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, or non-infringement.
We do not guarantee that the Services will always be uninterrupted, timely, secure, or error-free.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
17. Limitation of liability
To the fullest extent allowed by law, Mad Tea Party, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, licensors, Shopify, and Shopify’s affiliates will not be liable for any injury, loss, claim, or damages of any kind arising from your use of the Services or products purchased through them.
This includes direct, indirect, incidental, punitive, special, and consequential damages, such as lost profits, lost revenue, lost savings, lost data, replacement costs, or similar losses. This applies whether a claim is based on contract, negligence, strict liability, or another legal basis, even if we have been told that such damage could happen.
This also includes losses caused by errors or omissions in content, or by content or products posted, transmitted, or otherwise made available through the Services.
18. Indemnity
You agree to protect, defend, and compensate Mad Tea Party, Shopify, and their affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers against losses, damages, liabilities, claims, and reasonable legal fees arising from:
-
Your breach of these Terms or any document incorporated into them.
-
Your breach of a law or someone else’s rights.
-
Your access to or use of the Services.
We will notify you of a claim where possible. A delay in notifying you will not remove your obligations unless it materially harms your ability to respond to the claim.
We may control the defence and settlement of a claim at your expense, including choosing legal counsel. However, we will not settle a claim in a way that requires you to take non-financial action without your consent, which you must not unreasonably withhold. You agree to cooperate with the defence, including by providing relevant documents.
19. Severability
If any part of these Terms is found to be unlawful, invalid, or unenforceable, that part will be enforced as far as the law allows or removed where necessary. The rest of the Terms will remain valid and enforceable.
20. Waiver and entire agreement
If we do not enforce a right or term in these Terms, this does not mean we have waived that right or term.
These Terms, together with any policies or rules we post on the website or in connection with the Services, are the complete agreement between you and us about your use of the Services. They replace all earlier or current agreements, communications, and proposals, whether written or spoken.
Any unclear wording in these Terms will not automatically be interpreted against the party who drafted them.
21. Assignment
You may not transfer, assign, delegate, or give anyone else your rights or obligations under these Terms without our written consent. Any attempt to do so will be invalid.
We may transfer, assign, or delegate these Terms and our rights or obligations without giving you notice or obtaining your consent.
22. Governing law
These Terms and any separate agreement under which we provide Services are governed by the laws and courts—federal, state, or territorial—of the jurisdiction where Mad Tea Party is headquartered.
You and Mad Tea Party agree that those courts have jurisdiction over disputes and are the appropriate place to bring them.
23. Headings
Section headings are included for convenience only. They do not affect the meaning of these Terms.
24. Changes to these Terms
You can view the current version of these Terms on this page at any time.
We may update, change, or replace any part of these Terms by posting the changes on our website. You are responsible for checking the website for updates.
Where required by law, we will notify you of material changes. Those changes will take effect on the date stated in the notice. If you continue to use the Services after changes are posted or take effect, you accept the updated Terms.
